Terms of Service

By creating an account, visiting a creator profile, sending a gift, or otherwise using GiftMi (the “Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy.

If you do not agree to these Terms, do not use the Service.

• You must be at least 18 years old to use GiftMi.
• You must have the legal capacity to enter into binding contracts.
• For creators: You must own an active Instagram Creator or Business account with at least 10,000 followers.
• For fans: You must provide accurate information and a valid payment method (UPI, card, net banking via Razorpay).

Creatorssign up by verifying ownership of their Instagram handle via Instagram's Business Login. Upon successful verification, you set a password and gain access to your creator dashboard.

Fans are automatically registered after their first gift. We send a welcome email with a password setup link, which expires after 1 hour. You can use the same email to log in for future gifts.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

As a creator, you agree to:

• Provide accurate Instagram credentials and maintain ownership of your linked account.
• Add only legitimate products to your wishlist that are available on supported merchant sites (Amazon, Flipkart, Nykaa, Myntra).
• Provide accurate shipping address details so we can deliver gifts.
• Send thank-you notes to fans within a reasonable time after receiving gifts.
• Not list prohibited items (see Section 8) or use the platform for fraud.
• Promptly notify us if your Instagram account is suspended, disabled, or transferred.

As a fan, you agree to:

• Provide accurate billing information including a valid email and phone number.
• Pay the full amount displayed at checkout (product price + platform fee + GST).
• Not attempt to gift prohibited items or use stolen payment methods.
• Not send harassing, threatening, or inappropriate messages to creators.
• Accept that all gifts are final and non-refundable once the creator has received them (see Refunds section).

All payments are processed by Razorpay. By making a payment, you also agree to Razorpay's terms.

Fee structure (transparent at checkout):

• Product price — the price listed by the creator (sourced from the merchant URL).
• Platform fee: 8% of product price.
• GST on platform fee: 18% (as per Indian GST law).
• Total = Product + Platform Fee + GST.

All prices are in Indian Rupees (INR). You are responsible for any bank fees or currency conversion charges imposed by your card issuer or bank.

• Before fulfillment: If we cannot fulfill an order (e.g., item out of stock, merchant unavailable), we will refund the full amount within 5-7 business days.
• After fulfillment:Once we have placed the order with the merchant, refunds are subject to that merchant's return policy. Platform fees and GST are non-refundable after fulfillment.
• Failed deliveries: If a gift is undeliverable (wrong address, recipient unavailable), we will work with the creator to resolve, but may not be able to issue a refund if the merchant has already shipped.
• Cancelled orders: Refunds are processed back to the original payment method via Razorpay.

To request a refund, email contact@giftmi.in with your order number.

Creators may only add items that are:

• Sold by supported merchants (Amazon India, Flipkart, Nykaa, Myntra).
• Legal to purchase and ship in India.
• Not in any of the prohibited categories listed below.

Prohibited items include: alcohol, tobacco, firearms, ammunition, controlled substances, prescription medications, sexually explicit material, counterfeit goods, stolen property, live animals, hazardous materials, and any items illegal under Indian law.

We reserve the right to remove any wishlist item at our sole discretion.

You agree NOT to:

• Impersonate another person or misrepresent your identity.
• Use the Service for any unlawful, fraudulent, or harmful purpose.
• Attempt to gain unauthorized access to our systems, other user accounts, or any data.
• Reverse engineer, scrape, or copy our platform.
• Use bots, scripts, or automated tools to interact with the Service.
• Harass, threaten, or send abusive content via gift messages or thank-you notes.
• Manipulate analytics, fake gifts, or otherwise tamper with the Service's integrity.
• Use stolen credit cards or commit payment fraud.

The GiftMi name, logo, website, and all related content (excluding user-generated content) are the exclusive property of Velnir Tech Private Limited and protected by copyright and trademark law.

You retain ownership of content you upload (wishlist items, messages, thank-you notes), but grant GiftMi a worldwide, royalty-free, non-exclusive license to display, store, and distribute that content as necessary to provide the Service.

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms, fraud, abuse, or any other reason at our discretion.

You may delete your account at any time via the Data Deletion page.

Upon termination, your access to the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 10, 12, 13, 14, and 15) will survive.

The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. We do not warrant that:

• The Service will be uninterrupted, error-free, or secure.
• Wishlist items will always be available at the listed price (prices on merchant sites change).
• Deliveries will always arrive on time or in good condition.
• Information about creators (followers, account type) is always up-to-date.

To the maximum extent permitted by law, Velnir Tech Private Limited and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the total amount you have paid to GiftMi in the 12 months preceding the claim, or ₹10,000, whichever is greater.

You agree to indemnify, defend, and hold harmless Velnir Tech Private Limited and its affiliates from any claims, damages, liabilities, costs, or expenses (including attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your infringement of any third party's rights.

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in India.
